Scope & Who This Policy Covers

This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit our website, request a consultation, enroll in group programs, or otherwise interact with Wynn Advocacy. This policy applies to information we collect online and, where noted, to information you choose to provide to us through other secure channels. Our website and services are directed to U.S. residents.

We Never Sell or Share Your Personal Information for Marketing

Wynn Advocacy does not sell or share personal information for monetary consideration or for cross-context behavioral advertising. We do not sell or share children’s personal information, ever.

What We Collect

We collect the following categories of information:

Identifiers & Contact Data: name, email address, phone number, city/state, and similar identifiers.

Consultation & Intake Data: information you provide in forms, emails, questionnaires, or calls (e.g., concerns, goals, school district, grade level).

Parent-Provided Child/Student Information (Optional): if you choose to provide it, details about your child’s educational needs, IEP/504 history, accommodations, evaluations, and relevant records.

Sensitive Information You Voluntarily Provide (Optional): information about disability or health that you choose to share to obtain guidance; we do not request Social Security numbers or payment card numbers via our website forms.

Transactional Data: records of services purchased or requested (payment is processed by third-party processors; we do not store full card numbers).

Communications Data: your preferences and content of communications (email, SMS, phone, meeting notes).

Usage/Device Data: IP address, browser type, pages viewed, links clicked, referring URL, approximate location, and similar analytics data via cookies or similar technologies.

Audio/Video (If Applicable): if coaching sessions are recorded (only with notice and your consent).

Sources of Data: directly from you; from your authorized representatives; from your school district or third parties only with your authorization; and automatically via cookies/analytics.

Cookies, Analytics & Tracking

We may use cookies and similar technologies to operate the site, remember preferences, and analyze traffic. You can control cookies through your browser settings and/or any cookie banner we deploy. Disabling cookies may affect site functionality. We do not use cross-context behavioral advertising.

How We Use Information

Children’s Privacy & Student Information (COPPA-Aligned)

Website Not Directed to Children: Our website is intended for adults (see Terms & Conditions age limits). We do not knowingly collect personal information directly from children under 13.

Parent-Provided Child Information: Because our services relate to IEP/504 matters, parents/guardians may choose to provide information about their child. By submitting such information, you represent that you are the child’s parent/legal guardian or have lawful authority to share it, and you consent to our processing solely to evaluate and deliver the requested services.

Parental Verification: Wynn Advocacy may request reasonable steps to verify that anyone providing student information is the parent or legal guardian (such as confirming through signed forms, intake questionnaires, or direct communication).

Minimization & Secure Channels: Please avoid uploading sensitive student records via general web forms or email. Upon request, we will offer a more secure channel for document transfer.

No Sale/No Targeted Ads: We do not sell or share children’s personal information, nor do we use it for targeted advertising.

Parent Rights (COPPA Principles): Parents/guardians may request access to, correction of, or deletion of their child’s information in our possession (subject to legal/contractual retention requirements). Contact us at [email protected].

FERPA/HIPAA Note: Wynn Advocacy is not a school and is not a HIPAA “covered entity.” We are typically not directly subject to FERPA or HIPAA; however, we treat any educational or health-related information you provide as confidential and implement safeguards described in this Policy. Where a separate agreement (e.g., Business Associate Agreement, Data Processing Addendum) is required by a school district or provider, we will review and, if mutually agreed, execute it prior to handling records under that framework.

SMS/Text & Email Communications (TCPA/CAN-SPAM)

By providing your phone number or email, you expressly consent to receive messages from Wynn Advocacy, including service updates and—where permitted—promotional communications.

Opt-Out (SMS): reply STOP to any text to unsubscribe.

Opt-Out (Email): use the unsubscribe link in any marketing email.

Transactional Messages: you may still receive essential, non-marketing messages (e.g., confirmations, policy updates).

Charges: standard carrier rates may apply.

Wynn Advocacy will not sell or share your phone number or email for third-party marketing.

Disclosure of Information

We disclose personal information only as described below:

Service Providers/Processors: hosting, email/SMS platforms, scheduling, document-management, analytics, and payment processors—bound by contracts to use data only to perform services for us.

At Your Direction: with your explicit consent, e.g., to communicate with a school, district, or professional.

Legal & Safety: to comply with law, lawful requests, or to protect rights, privacy, safety, or property (including fraud prevention and security).

Business Transfers: as part of a merger, acquisition, restructuring, or asset sale, subject to this Policy.

We do not sell or share personal information for marketing or cross-context behavioral advertising.

Data Security

We use administrative, technical, and physical safeguards designed to protect personal information, access controls, least-privilege permissions, staff confidentiality commitments, and secure vendor selection. No system is 100% secure; we cannot guarantee absolute security.

Data Breach Notification

In the event of a data breach that compromises personal information, Wynn Advocacy will provide prompt notice as required by applicable federal and state law. Notices may be sent via email, website posting, or other lawful method. We retain information only as long as needed for the purposes described or as required by law. Typical retention:

General inquiries and non-client communications: up to 24 months.

Client matter files (including student information you provide): typically 3–7 years after last activity, unless a longer period is required by law or necessary to protect legal rights.

You may request deletion; we will honor it where feasible and lawful, subject to legitimate retention needs (e.g., compliance, dispute resolution).

Your Privacy Rights

Subject to verification and legal limits, you may request to:

Access the personal information we maintain about you.

Correct inaccurate personal information.

Delete personal information.

Port/Receive a copy of certain information.

Opt-out of marketing emails/SMS at any time (see Section 7).

State-Specific Disclosures

California (CPRA): We provide this notice to California residents about their rights to know, access, correct, delete, and limit certain uses of personal information. Sensitive personal information (e.g., disability/health details voluntarily provided) is used only to deliver services you request, not for inferring characteristics or for marketing.
